Terms of use

The rules that apply between you and BabyYouWay: access to the service, pathways, content, the free plan and the Premium subscription.

Draft text — to be validated by a qualified lawyer before any commercial launch. This document describes how the service is intended to operate. It has not yet been legally validated, it may change, and the items in square brackets remain to be completed.

1. Who publishes the service

2. What the service does, and what it does not do

BabyYouWay connects adults who want to have a child, through three pathways: the couple project, intentional co-parenting and, only in countries where it has been opened following a legal review, the donation pathway.

BabyYouWay is not:

  • a medical service, a clinic, a gamete bank or an intermediary in any transaction;
  • a legal advice service: no information on the site replaces the advice of a legal professional;
  • a guarantee of meeting someone, of compatibility, of pregnancy or of legal parenthood.

The service promises neither anonymity, nor the absence of rights or duties, nor parenthood, nor the performance of an agreement made between members. These matters depend on the law of each country and on the method used. A private agreement is never presented as sufficient.

3. Who can sign up

  • You must be at least 18 years old. No minor is admitted and no child profile is permitted.
  • An account corresponds to one single real person. In a shared project, each adult has their own account, gives their own consent and can withdraw at any time.
  • You provide accurate information and keep your login details confidential.
  • Verification that you are 18 or over may be required before you publish a profile or contact other members.

4. Availability by country

The interface is offered in seven languages. The availability of each pathway, however, depends on the country of residence and the project country that you declare; it is never inferred from your language or your IP address. A pathway may be open, on a waiting list or unavailable. The donation pathway is disabled by default.

BabyYouWay does not claim that every pathway is lawful or accessible in every country. It is your responsibility to check the law applicable to your situation.

5. Your profile and your content

  • Nothing new is visible before approval: every photo and every piece of public text is reviewed before publication. See the moderation and appeals policy.
  • Your main photo must depict you. An AI-generated illustration may be used as a secondary image, labelled as such, never as a main photo.
  • You remain responsible for what you publish and you confirm that you hold the necessary rights to your content.
  • You authorise BabyYouWay to host your content and to display it to the members concerned, for the sole purpose of providing the service and for as long as you are registered. [to be completed: final wording of this authorisation]

6. Rules of conduct

You undertake to comply with the community guidelines. The following in particular are prohibited: any sexual solicitation, harassment and discrimination, fraud and requests for money, the sale, purchase or exchange of gametes, any payment between members for a donation, impersonation and the collection of other members' data.

7. Getting in touch and messaging

To write to a member, you send them a contact request. Messaging only opens once they have accepted. Technical limits apply to everyone in order to hold back spam. You can block a person, leave a conversation or report content at any time.

8. Fictional examples and AI-generated illustrations

The site may display AI-generated illustrations and "example projects". These examples are fictional scenarios, always labelled as such: they do not correspond to any member, cannot be contacted and are not part of any plan.

9. Free plan and Premium subscription

  • The free plan lets you create and publish a profile, search, send contact requests and talk once both people have accepted.
  • Premium is an optional subscription. Prices, quotas and the comparison of the two plans are set out on the Pricing page. The total amount charged and the renewal frequency are shown before any payment.
  • The subscription renews automatically until it is cancelled. You can cancel online at any time; your benefits remain active until the end of the period already paid for, then your account returns to the free plan, without losing your conversations.
  • Payment is processed by a specialist provider. BabyYouWay neither sees nor stores your card number.
  • Premium gives no advantage when it comes to verification badges, moderation or permitted pathways. Quotas can never be bought individually.
  • Right of withdrawal, refunds and invoicing: [to be completed in accordance with the applicable consumer law].

10. Suspension and closure of the account

You can delete your account at any time from your settings. BabyYouWay may remove content, issue a warning or suspend an account in the event of a breach of these terms or of the community guidelines. Measures are proportionate, reasons are given and they can be appealed. No permanent exclusion is imposed by an automated system alone.

11. Personal data

The processing of your data is described in the privacy policy and in the cookie policy.

12. Liability

BabyYouWay uses reasonable means to ensure the security and availability of the service, without being able to guarantee the identity, intentions or statements of each member. Verification badges have a precise and limited meaning; none constitutes an absolute guarantee. [to be completed: liability clause to be drafted by legal counsel]

13. Changes to the terms

The terms are versioned. In the event of a significant change, you are informed and, where necessary, your agreement is requested again.
